The Bankruptcy laws allow people to eliminate or restructure their debt in the Federal Courts. The two most common types of bankruptcy available to individuals are Chapter 7 and Chapter 13 petitions.
Despite the changes to the Bankruptcy Laws in 2005, bankruptcy is still an option for individuals and families facing financial difficulties.
CHAPTER 7 Bankruptcy: Chapter 7 Bankruptcies (liquidation) are the most common type of petition and eliminate most of a debtor's unsecured debts (ie Credit cards, Medical Bills). A successful Chapter 7 results in a discharge where debt is forgiven not repaid. However, some debt is not dischargeable such as: Child Support, Alimony, Student Loans, Taxes and personal injury damages.
CHAPTER 13 Bankruptcy: Chapter 13 Bankruptcy (repayment plan) provides a solution for people who have regular income and can make regular monthly payments but have suffered a short-term financial setback such as an illness, loss of job or unexpected large expense. Many people looking to stop foreclosure or repossession choose Chapter 13 as it allows you to stay in your house, keep your car and catch-up on your debt over up to a five year period.
